Abatract

This article focuses on the solution and use of orphan works, that copyrighted works (books, music, records, film, etc) whose owner cannot be located. Nobody is willing to use the orphan works for fear that he/she will have to pay a huge amount of money in damages if the owner emerges. In this article, is to survey recently surfaced as an issue of orphan works provisions suggests that copyright protection and restrictions under the copyright laws, simply look at the problem of the Google Books Project, and the realities and a growing use tendency of orphan works, currently in the United States. Also, enact in attempts to explore the access that you can use to the library resources with the activation of the orphan works, and legislation that is necessary to provide a meaningful solution to the orphan works problem as we know it today.
